Cookies and Tracking Technologies
Our website uses cookies and similar technologies to improve your browsing experience, analyze site traffic, and understand how visitors interact with our content. Cookies are small data files stored on your device.
We use the following types of cookies:
- Essential cookies — required for the website to function (e.g., form submissions, session management)
- Analytics cookies — to understand how visitors use the site (e.g., pages visited, time on site)
- Marketing cookies — to measure the effectiveness of our outreach and advertising, which may involve advertising or analytics service providers
You can control or disable cookies through your browser settings. If you block essential cookies, some parts of the website, including forms, may not work properly. We do not sell personal information collected through cookies. Our site does not currently respond to Do Not Track signals; if we later honor browser-based opt-out signals such as Global Privacy Control, we will say so here.
Email, Phone, and Text Message Communications
We use your email address for two kinds of messages: service messages (for example, confirming your inquiry, updating you on an application, or sending documents) and promotional messages (for example, newsletters, financing resources, or announcements). Our emails may include a small tracking element that tells us whether a message was opened and which links were clicked. We follow the U.S. CAN-SPAM Act. Every promotional email includes our mailing address and an unsubscribe link, and we honor unsubscribe requests promptly. Service messages about an open request may still be sent after you unsubscribe from promotions.
Phone Calls
By giving us your phone number, you agree that we may call you about your financing inquiry and our services. You can ask us to stop calling at any time.
Text Messages
By giving us your mobile number, you agree to receive text messages from Walnut Hill Capital LLC about your inquiry, application status, and follow-up. Message frequency varies. Message and data rates may apply. Consent to receive texts is not a condition of receiving our services. To stop texts, reply STOP to any message. For help, reply HELP. Opting out of texts will not affect your ability to work with us.
We do not share or sell your mobile number or text-messaging consent to third parties or affiliates for their marketing or promotional purposes.
Changing Your Preferences
You can withdraw your consent to marketing or any of the communications above by using the unsubscribe or STOP options, or by writing to us at the contact details in Section 16.
Credit Inquiries and Fair Credit Reporting Act (FCRA)
In connection with evaluating your financing request, Walnut Hill Capital LLC and/or its lending partners may obtain consumer or business credit reports about you or your business from one or more credit reporting agencies. We do not obtain a credit report without your permission. Where an initial review is a soft inquiry, it does not affect your credit score. A lender may perform a hard inquiry later in the process, and we will tell you in advance if that is the case. When you authorize a credit review, you permit Walnut Hill Capital LLC and the lenders reviewing your file to obtain the reports needed.
Under the Fair Credit Reporting Act (FCRA), you have the right to:
- Know when a credit report has been obtained in connection with your application
- Receive a copy of any consumer credit report used to take adverse action against you
- Dispute inaccurate or incomplete information with the applicable credit reporting agency
- Be notified of the credit reporting agency used if adverse action is taken based on your credit report
Adverse action notices (if applicable) will be issued by the lender or funder making the credit decision, not by Walnut Hill Capital LLC. We encourage you to review your credit reports regularly at annualcreditreport.com.
Data Retention
We retain personal and financial information collected in connection with financing inquiries and applications for a minimum of five (5) years from the date of collection, or longer if required by applicable law or lender agreements. This includes records of submitted applications, supporting documents, and communications related to your financing request.
Upon expiration of the applicable retention period, information is securely deleted or anonymized. To request early deletion of your data (where not prohibited by law), please contact us at [email protected].
California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) may provide you with additional rights regarding your personal information. These rights may apply to sole proprietors, personal guarantors, and individual contacts associated with a business financing inquiry.
California residents may have the right to:
- Know what personal information we collect, use, share, or sell
- Request deletion of personal information we hold about you (subject to certain exceptions)
- Correct inaccurate personal information
- Opt out of the sale or sharing of personal information (we do not sell personal information)
- Non-discrimination for exercising your CCPA/CPRA rights
To submit a California privacy request, contact us at [email protected] with the subject line "California Privacy Request." We will respond within 45 days as required by law.
State Commercial Financing Disclosure Laws
Many states, including California, New York, Virginia, Utah, Georgia, Florida, and Connecticut, have laws that require commercial financing brokers to provide specific disclosures to business borrowers at the time of a financing offer. These disclosures — which include information such as the total amount financed, total repayment amount, and estimated APR — are separate from this Privacy Policy and will be provided to you as required by the laws of your state prior to your acceptance of any financing offer.
Walnut Hill Capital LLC is committed to complying with all applicable commercial financing disclosure requirements. If you have questions about the disclosures applicable to your transaction, please contact us at [email protected].
No Guarantee of Financing
Submission of a financing inquiry or application through Walnut Hill Capital LLC does not guarantee approval, the availability of any particular financing product, or any specific financing terms. Approval decisions are made solely by the lenders and funders to whom your application is submitted. Walnut Hill Capital LLC makes no representations or warranties regarding the likelihood of approval or the terms of any financing offer.
Third-Party Links
Our website may contain links to third-party websites, including lender portals, franchise resources, or industry publications. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third-party websites you visit.
Children's Privacy
Our website and services are intended for business owners and are not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected such information, please contact us and we will promptly delete it.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or business operations. When we make material changes, we will update the Effective Date at the top of this page. We encourage you to review this Policy periodically.
Your continued use of walnuthill.co after any changes constitutes your acceptance of the updated Policy.
